ConAir Sports Terms & Conditions.
Issue 3. Effective from
11th April 2008
i. Indemnity. The
Customer shall indemnify, defend, and hold harmless ConAir Sports Ltd, its
officers, employees, agents, distributors and dealers from and against any and
all liability, loss, damage, expense, costs (including, without limitation,
costs and fees of litigation) of every nature arising out of or in connection
with customer's failure to comply with any of its obligations herein contained,
except for such loss or damage which was caused by the sole negligence or
willful misconduct of ConAir Sports Ltd, its officers, employees, agents,
distributors or dealers, provided
however, that the ConAir Sports Ltd shall nevertheless have the right, if it so
elects and notifies the customer, to participate at the ConAir Sports Ltds
expense in the defence of any such suit or suits in which it may be a party,
without relieving customer of the obligation to defend the same.
ii. WARNING. All air sports can be dangerous even when practised under ideal circumstances. Pilot error, component failure, adverse meteorological conditions or sheer bad luck can in all aviation result in injury or death. Every customer purchasing goods or services whether directly or indirectly from ConAir Sports Ltd is warned that microlight, ultralight, hang glider and powered hang glider, paramotor and hovercraft flying and similar air sports are not controlled as are other forms of aviation. As a result components and related equipment are manufactured from commercially available materials and components and some of these materials and components are not designed specifically for aviation use. Engine and aircraft parts supplied, services and technical advice, are intended for use in permit and de-regulated aircraft, by definition the aircraft must be operated in a manor where a safe landing can be made at all times and an engine failure will not affect flight safety. Every purchaser must ensure that he inspects fully every purchased item upon delivery and before every flight thereafter and he must make himself aware of all trends or changes which may make a particular item unsuitable for the use for which it was originally purchased. He must also satisfy himself totally that a purchased item is suitable for the use to which he intends to employ it. ConAir Sports Ltd can offer advice but the final responsibility for the use of the goods purchased rests solely with the purchaser (whether direct or indirect) or other user who employs such goods at his own risk. This warning applies to every part item, service or any technical advice offered by ConAir Sports Ltd and acceptance of or payment for goods is an implicit acceptance of this warning.
iii. Amendments - We reserve the right to amend these Terms & Conditions from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to this Website. The date of the last revision to these Terms is provided at the end of the Terms. We recommend that you visit this page each time you visit the Website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect.
1. Conditions - All orders are accepted by ConAir Sports Ltd subject to and in accordance with these Conditions. These Conditions override and exclude any terms or conditions in or referred to in any negotiations or course of dealing between ConAir Sports Ltd and the Customer or set out in the Customer’s standard terms and conditions. Together with any terms accepted by ConAir Sports Ltd in connection with an order, these Conditions constitute the entire agreement between ConAir Sports Ltd and the Customer in relation to the Supplies ordered. No variation to these Conditions is permitted unless expressly authorised in writing by a director of ConAir Sports Ltd.
3. Payment - Payment is due in advance of dispatch of the goods, by
any of the payment methods specified on the ConAir Sports online shop website,
or by cheque drawn on a UK bank by special arrangement or by bank transfer for
orders of value over £100.00 and by special arrangement only, bank transfers
from outside the UK will be subject to a bank transfer fee of £10.00.
We will accept payment from third parties, however the contract is
considered to be with the person who placed the order.
4. Orders - ConAir Sports Ltd reserves the right to decline to trade
with any company or person.
5. Delivery - ConAir Sports Ltd will use all reasonable endeavours
to dispatch Goods as quickly as possible after the order is placed, however
please allow up to 28 days for delivery. Delivery
will be made to the address specified by the Customer.
ConAir Sports Ltd may use any method of delivery available to it.
ConAir Sports Ltd will use reasonable endeavours to meet delivery and/or
performance estimates but except as set out in 6 below, in no circumstances
shall it be liable to compensate the Customer for non-delivery, non-performance
or late delivery or performance. ConAir
Sports Ltd reserves the right to specify that large or expensive items may not
be available for delivery, in these circumstances, goods will be available for
collection from ConAir Sports premises by arrangement and at the customers
expense and liability.
6. Inspection, defects and non delivery - The customer or their representative must not accept for delivery any goods in damaged packaging. Any goods signed as having been delivered will be considered to have arrived in good condition.
The Customer must inspect the
Supplies as soon as is reasonably practicable after delivery and, except as set
out in 11 below, the Company shall
not be liable for any defect in the Supplies unless written notice is given to
ConAir Sports Ltd within 10 days of such date.
ConAir Sports Ltd does not write software comprised in the Goods and it
is the Customer's responsibility to check for the presence of computer viruses
before the Goods are used. The
quantity of any consignment of Goods, as recorded by ConAir Sports Ltd upon
despatch from ConAir Sports Ltd's place of business, shall be conclusive
evidence of the quantity received by the Customer on delivery, unless the
Customer can provide conclusive evidence to the contrary.
ConAir Sports Ltd will not be liable for any non -delivery of Goods
unless written notice is given to ConAir Sports Ltd within 10 days of the date
when Goods should have been delivered in the ordinary course of events.
Any liability of ConAir Sports Ltd for non-delivery or non performance or
for Goods notified as defective on delivery in accordance with this Condition 6
will be limited to replacing the Goods within a reasonable time or to refunding
the price then paid in respect of such Supplies.
7. Returns - Goods returned because they are unwanted or incorrectly
ordered, will be returned at the Customer’s risk and expense, for receipt by
ConAir Sports Ltd within 7 days from the day after the goods are received and
must be undamaged and in original packaging.
The Customer is responsible for returning Goods to the Company and for
providing proof of delivery of such return.
Any Goods returned in this way may be accepted at the discretion of the
Company but will be subject to a restocking fee of 30% of the invoice value of
the Goods (subject to a minimum charge of £10).
Any goods supplied in cut lengths or that have been made specifically to
a customers specification, such as propellers, will be subject to a restocking
fee of 80% of the invoice value of the Goods.
8. Description - All specifications, drawings, illustrations,
descriptions and particulars of weights, dimensions, capacity or other details
contained on this website are intended to give a general idea of the Supplies,
but will not form part of any Contract. ConAir
Sports Ltd shall take all reasonable steps to ensure the accuracy of details
relating to Supplies (including, without limitation, statements regarding
compliance with legislation or regulation), but accepts no liability in contract
or tort or under statute or otherwise for any error or omission in such detail
whether caused by ConAir Sports Ltd’s negligence or otherwise.
ConAir Sports Ltd may make changes to the Supplies as part of a
continuous programme of improvement or to comply with legislation.
9. Risk and ownership - The risk of damage to or loss of Goods will
pass to the Customer when the Goods are dispatched from ConAir Sports Ltd.
Ownership of the Goods shall not pass to the Customer until ConAir Sports
Ltd has received in full (in cash or cleared funds) all sums due from the
Customer to ConAir Sports Ltd on any account whatsoever. Until
ownership passes to the Customer, the Customer must hold the Goods on a
fiduciary basis as ConAir Sports Ltd's bailee.
10. Performance and fitness for purpose - Unless any performance
figures, tolerances, characteristics or compliance with legislation or
regulation have been specifically and expressly warranted by a director of
ConAir Sports Ltd in writing, ConAir Sports Ltd accepts no liability for any
failure of the Supplies to comply with such criteria, whether attributable to
ConAir Sports Ltd 's negligence or otherwise.
The responsibility for ensuring that Supplies are sufficient and suitable
for a particular purpose is the Customer's, unless specifically stated in
writing by a director of ConAir Sports Ltd.
Any advice or recommendation given by an employee of ConAir Sports Ltd
which is not confirmed in writing by a director of ConAir Sports Ltd is acted on
entirely at the Customer's risk and ConAir Sports Ltd shall not be liable for
any such advice or recommendation which is not so confirmed.
The liability of ConAir Sports Ltd to the Customer, should any warranty,
statement, advice or recommendation confirmed in accordance with this Condition
10 prove to be incorrect, inaccurate or misleading, will be limited to the
refund of the price paid for the Supplies or, at ConAir Sports Ltd’s option,
the supply of replacement Supplies which are sufficient and suitable.
11. Warranty/Guarantee - ConAir Sports Ltd is only liable to provide
warranty for items supplied by ConAir Sports Ltd to the original customer to
which the company supplied goods.
ConAir Sports Ltd will endeavour to transfer to the Customer the benefit of any
warranty or guarantee given by the manufacturer of Goods.
Warrantable goods are to be returned to ConAir Sports Ltd at the customers
expense. Upon receipt of warrantable
goods, ConAir Sports Ltd will, free of charge, repair or, at ConAir Sports
Ltd’s option, replace Goods which are proved to the reasonable satisfaction of
ConAir Sports Ltd to be damaged or defective due to faulty materials,
workmanship or design. This
obligation will not apply:

if the defect arises because the Customer has altered or repaired
such Goods without the written consent of ConAir Sports Ltd;
·
because the Customer did not follow the manufacturers’
instructions for storage, usage, installation, use or maintenance of the Goods;
·
if the Customer has failed to notify ConAir Sports Ltd of any
defect in accordance with Condition 7 where the defect should have been
reasonably apparent on reasonable inspection; or
·
if the Customer fails to notify ConAir Sports Ltd of the defect
within 12 months (or such other period as the Company shall specify at the time
of acceptance of the order for the Supplies, which in some cases may be a number
of hours of operation) of the date of dispatch of the Goods.
·
If the item or its components have fallen or been dropped.
·
If there is corrosion as a result of poor storage or inadequate
preparation for storage.
·
If there is miss-assembly of parts or components not assembled by
the manufacturer or ConAir Sports Ltd and supplied disassembled for packing and
transport purposes.
·
If there is corrosion emanating from stone chips or any other
impact or abnormal stress damage.
·
If work other than the maintenance set out in the product manual
has been carried out by anyone other than the manufacturer, ConAir Sports Ltd or
an engineer designated in writing by the manufacturer or ConAir Sports Ltd.
·
If there is incidental or consequential loss or damage.
·
If service bulletins from the manufacturer or ConAir Sports Ltd
have not been adhered to.
·
If there have been any occurrences of overheating or seizure of
engines due to prolonged high speed running of the engine, running with
excessive loads, running with inadequate loads or running with insufficient or
inappropriate oil.
·
If there is dirt, sand or foreign bodies in the engine or
consumables used.
·
If an engine has been run without suitable air, oil or fuel
filtration.
Postage or carriage to return a repaired/replaced item to the customer will be
at the customers expense.
It should be noted that time
before overhaul (T.B.O.) does not imply any warranty conditions or life
expectancy but is a maximum permissible service life.
All warranty work to be carried out at ConAir Sports Ltds workshop or other
facility designated by ConAir Sports Ltd. Warrantable
goods to be returned to ConAir Sports Ltd at the customers expense.
Any replacement Supplies made or Goods repaired under this Condition 11 will be
guaranteed on these terms for any un-expired portion of the period of guarantee
given on the original Supplies. Any
Goods which have been replaced will belong to ConAir Sports Ltd.
The Customer grants to ConAir Sports Ltd and its employees, agents and
representatives a right to enter onto its premises to effect any repair or
replacement under this Condition 11. The
Customer shall ensure that ConAir Sports Ltd’s employees agents and
representatives are provided with a safe and secure working environment while at
its premises and the Customer shall be responsible for isolating any computers
or processors requiring repair or replacement from its network and for making
back-up copies of any information on such computers or processors before ConAir
Sports Ltd’s arrival on site.
This Condition is ConAir Sports Ltd 's sole obligation and the Customer's sole
remedy for defective Supplies and is accepted by the Customer in substitution
for all express or implied representations, conditions or warranties, statutory
or otherwise, as to the satisfactory quality, fitness for purpose or performance
of the Goods (or any materials used in connection therewith) or the standard of
workmanship of the Services and all such representations, conditions and
warranties are excluded.
Rotax products supplied by ConAir Sports Ltd are manufactured for use on Rotax
engines in Ultralight Aircraft, and as such any use in any other application
invalidates the warranty.
Cors-Air products supplied by ConAir Sports Ltd are manufactured for use on Cors-Air
engines in Paramotor Aircraft, and as such any use in any other application
invalidates the warranty.
HKS products supplied by ConAir Sports Ltd are manufactured for use on HKS
engines in Ultralight Aircraft, and as such any use in any other application
invalidates the warranty.
Woodcomp products supplied by ConAir Sports Ltd are manufactured for use in
Ultraight or Paramotor Aircraft, and as such any use in any other application
invalidates the warranty.
If we supply goods or services under warranty, and we subsequently discover that
one of the conditions above was not met or that the fault was the customers
fault or was not warrantable for any reason, ConAir Sports Ltd reserve the right
to charge the customer for the goods or services supplied for a period of up
to12 months after the supply of goods or services.
WARNING - electrical and electronic items are often damaged by an outside
influence such as another faulty component, static electricity, incorrect wiring
etc.
11.A Second Hand Goods - Second
hand items are occasionally supplied in order to provide a cost or
labour saving for the customer. Second
hand good are only supplied after discussion and agreement with the customer. As
such no warranty shall be given for second hand goods supplied.
11.B Right to Re-call -
ConAir Sports Ltd reserve the right to re-call any product. Liability
will be limited to that given by our supplier. In
the event of a product recall the product may be replaced with an equivalent
item, or the price paid may be refunded, or a pro-rata offer may be made,
provided that the product is returned within the time limits of the recall.
ConAir Sports Ltd will not be responsible for any consequential loss or
any related costs including labour. ConAir
Sports Ltd will make reasonable endeavours to contact the original purchaser of
the product, it is the customers responsibility to pass on information if the
product has subsequently been re-sold. In
the event that a product is not returned within the time limits of the product
recall, and there is subsequent failure of the product, ConAir Sports Ltd will
not be under any obligation to the customer.
12. Intellectual property rights - Any supplies from ConAir Sports
Ltd may be subject to the intellectual and industrial property rights including
patents, know how, trademarks, copyright, design rights, utility rights,
database rights and or other rights of third parties. No
right or licence is granted to the Customer, except the right to use the
Supplies or re-sell the Goods in the Customer’s ordinary course of business.
ConAir Sports Ltd shall have no liability whatsoever in the event of any
claim of infringement of any such rights howsoever arising.
13. Force majeure - ConAir Sports Ltd shall not be liable to the
Customer in any manner or be deemed to be in breach of these Conditions because
of any delay in performing or any failure to perform any of ConAir Sports Ltd 's
obligations under these Conditions if the delay or failure was due to any cause
beyond ConAir Sports Ltd 's reasonable control (which shall include, but not be
limited to government actions, war, fire, explosion, flood, import or export
regulations or embargoes, labour disputes or inability to obtain or a delay in
obtaining supplies of Goods or labour). ConAir
Sports Ltd may, at its option, delay the performance of, or cancel the whole or
any part of a Contract.
14. Legal construction - All Contracts shall be governed by and
interpreted in accordance with English law and the Customer submits to the
jurisdiction of the English Courts, but ConAir Sports Ltd may enforce such
Contract in any court of competent jurisdiction.
15. General - Any provision of these Conditions of Supply which is
held by any competent authority to be invalid, void, voidable, unenforceable or
unreasonable (in whole or in part) shall to the extent of such invalidity,
voidness, voidability, unenforceability or unreasonableness be deemed severable
and the other provisions of these Conditions of Supply and the remainder of such
provision shall not be affected. Failure
by ConAir Sports Ltd to enforce or partially enforce any provision of these
Conditions of Supply will not be constrained as a waiver of any rights under
these Conditions of Supply. ConAir
Sports Ltd must be given the opportunity to put right any failure of service and
will not cover the costs of any third parties contracted by the customer in
respect of any dispute or expert investigations regarding such matters.
Additional Terms & Conditions for Technical Advice Given
17. Availability of Service
- ConAir Sports Ltd will use reasonable endeavours to ensure that this
service is available to you, however, ConAir Sports Ltd cannot not guarantee
uninterrupted availability of technical support.
Technical Support will usually be given by telephone and on the basis
that an Engineer will telephone you / return your call at a time convenient to
ConAir Sports Ltd.
18. Liability - ConAir Sports Ltd shall not be liable for any of the
following type of loss or damage arising out of or in connection with any
technical advice given by us, either verbally or in writing:
Any damage to components, products or parts fitted (or to anything they are
fitted in)
Any loss of profits, loss of earnings, loss of anticipated savings, goodwill or
revenue;
Any loss or corruption of data;
Any indirect or consequential loss;
Any death or personal injury.
19. Benefit of advice - Advice and/or guidance may be given without
benefit to ConAir Sports Ltd by way of sales or of any other nature.
Additional Terms & Conditions for Training or Service Courses
21.
Skills - It is necessary to have an appreciation and have operated one of
the engines prior to attending the course to get the maximum benefit from it.
We only deal with permit aircraft engines and as a consequence the course
is based on the more relaxe
22. Booking Information - We
require name, address, telephone number and email address for each participant,
preferably at the time of booking, but at least 4 weeks in advance of the course
date.
23. Cancellation –
ConAir Sports Ltd may cancel your Course if you fail to pay the outstanding
balance by the due date. We also
reserve the right, where necessary, to cancel your Course at any time prior to 2
weeks before your start date. In
this last case we will offer you a full refund.
ConAir Sports Ltd will only cancel the Course within 2 weeks of the start
date for reasons beyond our control. If
we cancel your Course our only liability to you will be to refund promptly all
monies paid by you to us in respect of the Course.
ConAir Sports Ltd will only effect the cancellation of a booking by a customer
upon receipt of written notice to do so, duly signed by you.
To compensate us for the risk that we might not be able to resell your
place on the course, and for the fact that there is no less work required in
running the Course for one less attendee, we shall be entitled to impose a
charge as shown below. Where
applicable we shall deduct the cancellation charge from any balance previously
paid by you in respect of the Course.

24. Force majeure – ConAir Sports Ltd shall not be responsible to you in the event that we cannot provide the Services to you due to an event beyond our reasonable control, which includes (but is not limited to) events such as, fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or the actions of any government or public body. In the event that we are prevented from providing the services by such an event, we will take all reasonable steps to try to reinstate the provision of the services to you as soon as is reasonably practicable.
25. Responsibility - In no event shall we be responsible to you for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer. Further, in no event shall we be liable to you for any indirect or consequential loss that you may suffer.
26. Course Materials - We
will provide you with course materials on the first day of your course. You may
not makes copies of any Course Materials supplied to you in hard copy format. We
will provide technical support for participants of the course.
This will be on a ring back basis and as per our terms and conditions for
Technical advice given above.
27. Qualification - A
certificate will be issued at the end of the course to indicate attendance and
participation in a particular course. This
does not constitute an endorsement of the participants ability or skill or any
formal qualification. You will not
be Rotax trained or approved and must not imply that you are.
You will have been trained by ConAir Sports to carry out work to the
relevant level. ConAir do not
approve any third parties on behalf of themselves, Skydrive, Rotax or any one
else.
28. Relevancy - ConAir
Sports Ltd will endeavor to cover as many subject areas as possible and to
ensure that the information is up to date as per the manufacturers’
recommendations, however the responsibility lies with the participant to ensure
that they are following the manufacturers up to date recommendations and
procedures and complying with any legal obligations.
Additional Terms & Conditions for Job Bookings
30. Booking
information - We
require the following information: Name, address, telephone number, engine type,
engine serial number, aircraft type, location for work to be carried out, nature
of work to be carried out. This
information should preferably be given at the time of booking.
In the event that this information is not received by ConAir Sports Ltd
at least 7 days before the date of the job booking, this could result in the
wrong work being carried out or the worng parts being supplied.
31. Job Details - We
will give an approximate time of arrival of our engineer on site, if applicable.
If an estimate is required for the cost of the work, ask at the time of
booking, and we will endeavour to provide an estimate within 7 days of the job
booking.
32.
Workshop booking - If
the work is to be carried out at our workshop, we will expect the
engine/aircraft to arrive by 9am on the day of the booking for the work to
commence. We will charge from 9.30
unless otherwise agreed. We do not
expect you to stay on site unless by prior arrangement.
33.
Cancellation
- In the event of a cancellation with less than 96 hours notice there is a
cancellation fee of £50 per day + costs i.e. if we get any parts in
specifically or have travelled to site.
Additional Terms and Conditions of Service Work on 2 stroke Engines
35. Price
– The price for the service will be as
listed or estimated unless further work is found to be required during the
course of the service. If no limit
has been specified by the customer, the budget will be considered to be
unlimited.
36. Cancellations
– Any cancellations with less than 96 hours notice will be subject to a
cancellation fee that may include travelling charges.
Any items that ConAir Sports Ltd has purchased specifically for any
cancelled work will be charged at full retail price.
37. Service Bulletins/Modifications
– As it would greatly increase the cost of every job to investigate compliance
to all relevant service bulletins and modifications, ConAir Sports Ltd will only
implement bulletins or modifications as requested by the customer.
It is the owners responsibility to ensure that all relevant documentation
is completed an
38. Engine installations in aircraft – It is the purchaser’s
responsibility to ensure that any work carried out or any items fitted or
installed by ConAir Sports Ltd are in accordance with the aircraft manufacturers
or approval requirements. ConAir
Sports Ltd is unable to investigate all variants of installations of Rotax
engines, and will generally follow instructions issued by the engine
manufacturer.
39. Service checklist –
Not all items listed in the Service Checklist are included in all services.
For example changing of the cross gear lubricant is included as part of a
100 hour service but not in a 50 hour service, and some items are particular
only to certain engines.
40. Non engine service items –
Please note that, due to the variation in systems used between aircraft types,
the following items that appear in the Rotax service schedule are not included
as part of our normal service work as it would
not be economical for us to do so: a)
Lubricate control cables; b) Balance
and track propeller; c) Clean and
oil air filter(s); d) Check fuel
filter.
41. Checks after engine service 1
– Following all service work involving the removal of the cylinder head(s) and
exhaust manifold(s), where new gaskets have been fitted, the cylinder head and
exhaust manifold nuts should be checked for correct torque after the first 2
hours running. Where the engine is
installed in a manner giving access to these nuts, then we recommend the
procedure is carried out. Some installations require major dismantling work to
gain access to these nuts and in these circumstances it is not practical to
complete the check. Without the
check, it is possible for an oil leak to develop, although a minor seep of oil
from the exhaust manifold gasket is not significant to the state of
airworthiness of the aircraft. A
larger leak from the exhaust manifold or a leak from
the cylinder head must be dealt with.
42. Checks after engine service 2
– Following service work involving the renewal of gearbox components (other
than shims or ring halves) the gearbox oil must be changed after 10 hours
running time.
43. Checks after engine service 3
– Following renewal of contact breaker sets the contact breaker gaps and
ignition timing should be checked, and where necessary adjusted, after 10 hours
running time.
44. Re-connection of controls –
If the engine is re-installed on the aircraft by others, then particular
attention must be paid to the throttle controls, to ensure correct assembly at
the carburettors. Twin carburettors
must be synchronised at idle and throughout their full operating movement.
Idle adjustment is carried out with the idle screw(s), cable adjusters
are used to synchronise the slides or butterflies.
Carburettor security, rubber manifold security and cable grommets must be
checked. Carburettors must be fitted
at 90°
to the engine in plan view and in vertical alignment with the cylinder.
If the carburettors were not supplied with the engine for service, they
must be checked for wear.
45. Dual control inspection – It
is a legal requirement to carry out a dual inspection prior
to flight, of any aircraft primary control system (including
throttle controls) after disconnection an

47. Log Books – It is the engine owners responsibility to ensure
that the engine log book is updated for all work carried out to the engine.
48. Regular engine runs and corrosion
inhibition – To prevent corrosion within the engine and serious reduction
in engine life the engine should be run, until normal operating temperatures are
reached, at least once every two weeks. If
this is not possible, then we recommend the use of an oil
with good inhibiting properties and the propeller should at least be turned
through a few revolutions every couple of weeks.
If it is anticipated that the engine will not be run for a period of more
than a month, then full corrosion inhibition treatment must be followed as per
your engine manual.
49. On going maintenance – For

50. Work carried out on site –
Site work may be carried out by request. It
shall be the customers’ responsibility to ensure adequate access and that the
work can be completed without interference from other trades.
Site work will be charged in accordance with the special rates in force
at the time; any waiting time incurred through events out of our service
engineers control, shall be charged extra at the current site rate.
It shall be the customers’ responsibility to ensure that adequate
public liability insurance is in force to cover our service engineers working on
the site, or to arrange for the site to be secured from access by any persons
during the work or subsequent test running of engines.
51. Warranty – Service work on
Rotax engines is warranted against defective parts or workmanship by ConAir
Sports Ltd, for a period of 3 months or 50 hours engine operation.
Liability shall be limited to that given by the engine manufacturer.
ConAir Sports Ltd shall not be liable if the engine is installed or
operated in a manner other than that specified by the engine manufacturer.
A completed engine operation log must be presented with any claim for
warranty by the purchaser of the service work.
ConAir Sports Ltd’s liability in respect of any defect or faulty
workmanship is limited to making good by replacement or repair, at its option,
the defective item(s). Warranty work
will be carried out in our workshop, carriage paid by the purchaser.
If warranty work is carried out on site, the purchaser will be
responsible for payment of travelling charges at the current rate.
The engine presented to ConAir Sports Ltd for a warranty claim must be in
the same form as presented for the original job (e.g. removed from the airframe)
unless agreed beforehand with the ConAir Sports Ltd service engineer in order to
demonstrate a particular problem. Warranty
claims shall not be considered by ConAir Sports Ltd unless and until full
payment for the services has been made.
52. Free issue components – Free
issue items must be supplied to ConAir Sports Ltd fit for purpose and with all
necessary fitting instructions (if no fitting instructions are supplied, ConAir
Sports will fit the components to the best of their ability and knowledge).
ConAir Sports Ltd shall not under any circumstances be held liable for
any free issue items supplied by the purchaser of the work or any third party,
in respect of failure of components, whether due to faulty goods or poor
workmanship by our personnel or our contractors.
The purchaser shall be responsible for all payments to make good any
damage relating to free issue items. ConAir
Sports Ltd not commenting on the suitability of free issue parts does not mean
that they are suitable.
53. Consequential loss – ConAir
Sports Ltd shall not under any circumstances be held liable for loss, injury or
damages to the purchaser or any third party or their property in respect of any
claims arising from work carried out by the company.
This includes any parts fitted by ConAir Sports Ltd that were “free
issue” from the purchaser or any third party.
Engine service work is only accepted by ConAir Sports Ltd on the basis
that the aircraft to which the engine is fitted is of a type suitable to land
safely without damage in the event of an engine failure, and that a forced
landing site is available through all stages of flight.
54. Privacy – ConAir Sports Ltd shall not, under any
circumstances, be held liable for any claim resulting in the release of any
information to a third party, relating to work carried out by ConAir Sports Ltd.
Additional Terms and Conditions for Service Work on 4 Stroke Engines
56. Price – The price for the service will be as listed or
estimated unless further work is found to be required during the course of the
service. If no limit has been
specified by the customer, the budget will be considered to be unlimited.
57. Cancellations –
Any cancellations with less than 96 hours notice will be subject to a
cancellation fee that may include travelling charges.
Any items that ConAir Sports Ltd has purchased specifically for any
cancelled work will be charged at full retail price.
58. Service Bulletins/Modifications – As it would greatly increase
the cost of every job to investigate compliance to all relevant service
bulletins and modifications, ConAir Sports Ltd will only implement bulletins or
modifications as requested by the customer.
It is the owners responsibility to ensure that all relevant documentation
is completed an
59. Engine installations in aircraft – It is the purchaser’s
responsibility to ensure that any work carried out or any items fitted or
installed by ConAir Sports Ltd are in accordance with the aircraft manufacturers
or approval requirements. ConAir
Sports Ltd is unable to investigate all variants of installations of Rotax
engines, and will generally follow instructions issued by the engine
manufacturer.
60. Service checklist – Not all items listed in the Service
Checklist are included in all services. For
example a compression check is included as part of a 200 hour service but not in
a 100 hour service, and some items are particular only to certain engines.
61. Non engine service items – Please note that, due to the
variation in systems used between aircraft types, the following items that
appear in the Rotax service schedule are not included as part of our normal
service work as it would not be economical for us to do so:
a) Lubricate control cables; b)
Balance and track propeller; c)
Clean and oil air filter(s); d)
Change fuel filter. It may be
possible for these to be carried out, but adequate advance warning must be given
and additional charges will apply.
62. Checks after engine service – Following service work involving
the renewal of gearbox components (other than shims or ring halves) the engine
oil must be changed after 25 hours running time.
63. Re-connection of controls – If the engine is re-installed on
the aircraft by others, then particular attention must be paid to the throttle
controls, to ensure correct assembly at the carburettors.
Carburettor security, rubber manifold security and cable grommets must be
checked. Carburettors must be fitted
at 90°
to the engine in plan view and in vertical alignment with the cylinder.
If the carburettors were not supplied with the engine for service, they
must be checked for wear. The
carburettors must be pneumatically balanced by an experienced engineer.
64. Dual control inspection – It is a legal requirement to carry
out a dual inspection prior to flight, of any
aircraft primary control system (including throttle
controls) after disconnection an

66. Log Books – It is the engine owners responsibility to ensure
that the engine log book is updated for all work carried out to the engine.
67. Regular engine runs and corrosion inhibition – To prevent
corrosion within the engine and serious reduction in engine life the engine
should be run, until normal operating temperatures are reached, at least once
every two weeks. If this is not
possible, then we recommend the use of an oil
with good inhibiting properties and the propeller should at least be turned
through a few revolutions every couple of weeks.
If it is anticipated that the engine will not be run for a period of more
than a month, then full corrosion inhibition treatment must be followed as per
your engine manual.
68. On going maintenance – For continue

request. It shall be the
customers’ responsibility to ensure adequate access and that the work can be
completed without interference from other trades.
Site work will be charged in accordance with the special rates in force
at the time; any waiting time incurred through events out of our service
engineers control, shall be charged extra at the current site rate.
